At the home Wednesday morning, air conditioning repairmen worked while landscapers laid down new sod.

About 11:30 a.m., a second of Crist's three staffers, Brad Rawls, arrived in jeans and sandals. He initially said he was there to "help him out" then clarified that he was shuttling paperwork for Crist, who was working from home. From his front lawn, Crist said Johnson was inside the house working. When asked if he had used Johnson in this capacity before, Crist said Johnson had helped once about five weeks ago, but he could not recall what day it was. In that instance, Johnson also took a personal day, Crist said.

Crist called later to say that Johnson had reminded him the earlier occasion was a Saturday and didn't require a personal day. Johnson earns $33,672 per year. When asked for documentation for State Sen. Victor D. Crist said he didn't break any rules.

Wednesday's personal leave day, Crist said Johnson had not filed his time card for February. Legislative assistants file time cards on a monthly basis and have within a week after the end of the month to submit their documentation, Johnson said. Johnson said Crist had a problem with workers not showing up, so he decided to help his boss. "I can always use the money," he said. "I'm not doing anything too big." As for Rawls, he was on the clock.

He was dressed casually because he did not have meetings that day, Crist said. Crist said he signed five bills and three pieces of correspondence that Rawls transported Wednesday. Senate rules do not prohibit legislative assistants from performing outside work on an "isolated" basis, but require advance written permission for any regular outside job. Last year, Florida Republican gubernatorial candidate Tom Gallagher was questioned for employing one of his subordinates at the Department of Financial Services to manage his six rental properties in Tallahassee. The employee used his state vehicle for personal business, which raised a perception issue.

In 2003, former Hillsborough County Attorney Emmy Acton came under fire when several of her employees filed anonymous complaints accusing her of being an abusive boss and of pressuring them to buy her castoff clothes at an office sale. One complaint said an employee cleaned toilets at Acton's home. Acton said an employee helped set up for an office party there, but she had no knowledge of cleaning any toilets. And in 2002, the state Ethics Commission investigated allegations that Hillsborough Public Defender Julianne Holt had employees work for her re-election campaign on office time, using office employees to do personal errands for her and using staff to prepare materials for college courses she was paid to teach. The charges were later dismissed.

Crist, 49, has been in the Legislature since 1992 and is the senator in charge of overseeing state funds for state courts, prosecutors and public defenders. The senior member of the Hillsborough delegation in his final term in the Senate, Crist said Johnson worked late Tuesday to prepare for the move to Tallahassee and cleared his schedule to help on Wednesday, sweeping and rolling up carpet. "I'm aware of the law," Crist said. "I didn't break any rules." Fellow state Sen. Charlie Justice chuckled when told of the arrangement between Crist and Johnson.

"Wow. That's interesting," he said. "I hope he's paying him well." Justice, D-St. Petersburg, said he and his wife clean their own house, and he doesn't pay his staff to perform personal work for him. "I've asked them to run an errand here and there," Justice said.
